Putting Attorneys on the Witness Stand
What would possess a litigant to put his attorney on the witness stand or the attorney’s advice at issue?   At first glance, many tactical considerations weigh in favor of such efforts.   For example, in today’s environment of complex commercial litigation a litigant’s attorney typically has the best command of the facts.   Unlike other witnesses who may only be privy to pieces of the puzzle, the attorney is uniquely situated to be a “big picture” person as a result of having gathered and marshaled the facts. The Lawyer as Statesman
Is law at essence now about sharp elbows, back-biting, Attila run amuck, fundamentally reduced to head-spinning mergers, portable billings, lateral moves galore--not just a business, but closely approximating a franchise business, with mandatory-hours quotas, and where quantity trumps quality (and quality of life)?  Not so fast. The thesis here is that the statesman and stateswoman was always at the heart of the profession. We just need once again to be reminded of the power of statesmanship.
