When a premises security claim is brought against a hotel or motel, management must immediately secure all relevant documentation and other materials that could aid defense preparations, including security and maintenance logs, incident reports, surveillance tapes, witness names and statements, guest registrations, and phone logs. Defense lawyers should promptly retain an investigator and a security expert with a specialty in hotel safety to review all available information and, where possible, to help formulate a viable defense.
