About Class Actions Today

While the 2005 Class Actions Fairness Act was enacted in response to pressure from business interests to limit the number of class actions, the contents of the Act itself are not expressly hostile to the class action mechanism. The higher certification bar and shift of venue for larger cases to federal courts have curtailed the number of cases and limited some of the more abusive practices, but large awards and settlements continue to be a feature of the class actions landscape as plaintiff's lawyers learn how to succeed in the new environment.
