It seems to be a fairly widespread belief that premarital agreements are easy to break. This is a myth. Courts rarely refuse enforcement. However, whenever a premarital agreement is challenged the proponent of the agreement must incur the risk and expense of defending validity. From the standpoint of a party to a premarital agreement who is in the weaker bargaining position, there is only one chance to get it right. This program focuses on the lawyers role in representing a party to a premarital agreement at the negotiation and drafting stage. Linda Ravdin will discuss the basics of validity with an emphasis on what the lawyer for the proponent can do to enhance validity and reduce risk for his or her client. She will also discuss the point of view of the lawyer for the weaker party and how that lawyer can work to improve the outcome for his or her client.
