Reimbursement under the Medicare and Medicaid programs, among other federal and state health care programs, are an essential component of the services health care providers and other entities deliver to their patients. With receipt of these funds, however, these entities are subject to potential civil actions brought under the federal False Claims Act (FCA). Over the last 20 years, the Department of Justice has collected billions of dollars through FCA actions. At the prodding of the federal government, most states have adopted statutes similar to the FCA or amended their existing statutes to conform to the FCA. As reflected in the health care reform efforts last year, it is clear that the FCA will continue to be a primary tool in federal and state initiatives to curb health care fraud and abuse.
