This session delves into the ever-changing psychology of the modern fact finder, be it jury, judge, or arbitrator. It discusses the impact of social media and the economic downturn on the modern factfinder.

With 500 million people on Facebook worldwide and nearly 2 billion people using the Internet, these sources have become a major factor in the filter through which each individual views the evidence presented in a case. Juries and other factfinders are programmed to create a story and they do that by filling in the blanks based upon their own experiences. In doing so, 2/3 of the people will "remember" seeing or hearing things that were not there (a process that will be demonstrated through a test as part of this program).

This mp3 audio download program provides insight into how this process might impact a trial and how its impact can be controlled. The panel guides the audience with real life examples of how typical attitudes about responsibilities, information, and experts can shape an outcome. Dr. Patterson also addresses the types of presentations that lead to better comprehension by the factfinders.

This mp3 audio download program also assesses the impacts of social media on the daily aspects of the trial, examining how social media can be used in the jury selection process and how to monitor social media for irregularities during the trial. The program also looks at how jurors can use the internet to do their own "research" on the issues in a case and see how the caselaw has developed around this phenomenon. Mr. Thorton closes by putting the lessons of the program to use in assessing an unusually one-sided outcome in a high-profile construction case from St. Louis, MO.
