Description

Achieving settlement in the high-stakes and highly visible area of healthcare enforcement litigation is difficult for even the most experienced practitioner.

This mp3 audio download program will explore the critical variables each party considers as they enter and carry out settlement negotiations. The discussion will probe the factors which create resistance or willingness to settle as well as the impact of ever-present parallel proceedings including: the relator's share and employment claims, shareholder suits, personal injury mass tort cases, potential debarment proceedings, and potential individual liabilities.

Our panelists, including a former Magistrate Judge and Deputy General Counsel of a medical device company, a veteran healthcare fraud prosecutor, and an accomplished defense litigator, will address:
  • when the timing is right for settlement;
  • evidentiary concerns, including issues surrounding the sharing of evidence;
  • damages, multipliers, disgorgement and other financial variables;
  • the interplay of criminal and civil liabilities;
  • the competing interests of entities and individuals; and
  • the role that parallel civil and administrative proceedings play in complicating or facilitating settlement.
