There are many reasons for the recent focus on Circular 230 and the IRS's Office of Professional Responsibility: disciplinary determinations are now made public; the potential sanctions and persons subject to sanctions have been expanded; OPR has been actively and publicly pursuing its mission, and the substantive rules have been significantly revamped. To date, the publicized disciplinary determinations have been limited to failure to file, failure to pay and other obvious wrong-doing. OPR, however, has been clear that its focus is shifting to more substantive cases-such as those that involve recent changes to advice standards and the expansion of sanctions to firms and responsible persons.
This panel will consider the next shoe to drop in OPR disciplinary proceedings. When will we start to see advice-givers and return preparers disciplined? When does a practitioner cross the line from giving advice that turns out to be wrong to giving advice that merits sanction? Will we see practitioners disciplined for mistakes and bad judgment or only for willful conduct? Do we all agree on which is which? Under what conditions will OPR pursue firms and responsible persons? What factors will OPR use to determine appropriate sanctions?
