Trade associations face a dilemma when legal issues arise that affect more than one company in the industry. A coordinated legal strategy among the association and its corporate members may be beneficial in ultimately resolving the legal issue but it poses the risk of creating evidence that will be discoverable by adverse parties during the litigation. Cooperative efforts can create ethical issues if common interests later diverge.
This CLE program will explore the status of the attorney-client relationship where a trade association and its member companies are involved, the current state of attorney-client privilege for in-house lawyers in the United States and E.U., the limits of the work product doctrine in light of recent U.S. cases, and the best practices for lawyers representing trade associations and their members.
