Incivility in the law is nothing new. Chief Justice Warren Burger once criticized the attorney who compared zealous advocacy to "how loud he can shout or how close he can come to insulting all those he encounters." Chief Justice Warren Burger, Remarks to the American Law Institute (1971). Until recently, stories of incivility have largely been anecdotal at best. But the past few years have seen an influx of case law addressing the rise of incivility in depositions and trials and everything in between. This presentation will address the history and pervasiveneess of incivility, and pay particular attention to its relationship to the Model Rules of Professional Conduct. Specifically Model Rule 3.3 (Candor to the Tribunal) and Model Rule 8.4 (The Integrity of the Profession).
