Abstract
Many employers view social networking sites and use search engines to vet their candidates, or to monitor current employees. While legitimate reasons exist to engage in these practices, employers need to be mindful of the relevant legal issues including claims of unlawful discrimination, violations of the National Labor Relations Act, invasions of privacy and First Amendment claims, and terms of service violations. The article includes pointers for employers wishing to craft policy in this area.
