Shapiro critiques three cases: (1) an eighth circuit decision holding that the Constitution precludes judges from using unpublished opinions; (2) a California case examining the conflict of an insurance company appointing staff attorneys to represent the insured; and (3) an eleventh circuit example of an attorney "doing law" instead of "seeking justice" for his client.
