This book is designed to help corporate counsel successfully settle commercial disputes through mediation. There are any number of articles and books written on managing litigation, overseeing outside counsel, and preparing for litigation or arbitration. However, few look at mediation from the perspective of in-house corporate counsel and the unique role they can play in mediation. This step-by-step guide is designed specifically for corporate counsel both within the United States and internationally. Topics include: an overview of the mediation alternative for corporate counsel; drafting mediation clauses; court-directed mediations; selecting the "right" mediator for your case; preparing a case for mediation; participating in the mediation sessions; follow-up action after the mediation; and cross-cultural mediations.

"Written in simple brass tacks fashion, this engaging book presents a mix of hard information and coaching in the art of successful mediating, all based on succinctly explained theory and authority ... It explains sensitive subjects like cross-cultural communication, fee-shifting, negotiation styles and how to handle an impasse or second thoughts. Best of all, its language is crafted squarely for inside counsel's use. Studying this book will launch new ways for inside counsel to add value and save cost."
David H. Burt Corporate Counsel, DuPont Wilmington, DE
"This clearly written and well-organized book is a valuable primer for corporate counsel contemplating or engaging in mediation. Written from the vantage point of corporate counsel, it is tailored to meet the needs of in-house counsel responsible for facilitating internal decision-making and working with outside counsel." Hal Abramson, Professor of Law, Touro Law Center Central Islip, NY
"I wish this book had been available before I managed two mediations for my company within the past year because it contains just the combination of tactical and practical advice that I could have used to more effectively manage those mediations. This book was written by is a former in-house counsel which makes it a significantly more valuable resource because he understands the challenge we face ... This book strikes a perfect balance in the amount of information provided. There is enough information to equip you to make effective decisions and fully advise your clients without making this resource too unwieldy and overloading you with excessive information."
Christopher R. Ryan Deputy General Counsel, K12 Inc. Herndon, VA
"This book will be very helpful for all companies that may face a dispute and want to resolve it in the most efficient way through mediation. The book gives very useful tools to enable the in-house legal, business, and technical teams to identify together the most appropriate way to instruct outside counsel and settle the dispute."
Eric Biesel Director, Arbitration and Mediation Chamber of Commerce, Industry and Services of Geneva Geneva, Switzerland
