In negotiating a commercial lease, the parties must consider how destruction of the premises might prevent the tenant from doing business, interrupt the flow of revenue, and disrupt the general economics of the landlord-tenant relationship. By carefully allocating risks and economic burdens, especially when property is located in areas prone to natural disasters, both landlords and tenants can prevent unintended and devastating financial consequences in the future.
