Description

A lawyer experiencing personal difficulties, mental illness, or substance abuse is much more likely to make a mistake or fall below an expected level of excellent client service. This can expose a firm to ethics violations, malpractice claims, and public embarrassment. It is critical that law firms recognize and help "at-risk" individuals. This program shows you the most effective techniques for dealing with the difficult situations, raised by four common "at-risk" scenarios:
  • A "bully" lawyer treating staff badly
  • Senior partner with failing billings
  • Substance abuse/addiction
  • Depression/mental illness
In the discussions of these scenarios you will get practice direction on how firm management should respond, where the legal landmines are, and how to address the need to balance the privacy interests of an impaired attorney or staff member against the risk management responsibility of the firm. The materials include comprehensive checklists that will help you determine a lawyer's "at-risk" status.
