This two-part webinar series will take an in-depth look at how the Centers for Medicare and Medicaid Services have changed the Medicare Shared Savings Program (MSSP) through the publication of final regulations. CMS has changed a number of the key provisions of the proposed MSSP rules, which were broadly regarded by the provider community as discouraging participation in the MSSP.
A panel of practicing lawyers familiar with the proposed rule, and the practical implications of its key provisions, will take a second, in-depth look at the final rule and offer their insights on whether CMS' changes are sufficient to encourage participation in the MSSP.
Among other provisions, the panelists will focus on:- the elimination of two-sided risk from Track 1,
- CMS' willingness to provide data on a prospective assignment basis;
- the substantial reduction of quality metrics;
- the more immediate opportunity to share savings above the minimum savings rate;
- the ACO legal structure and governance;
- additional waivers and guidance from enforcement agencies to facilitate ACO formation;
- expansion of participants and;
- modifications to several other hot spots that led to widespread discouragement with the MSSP as initially proposed.
