March 25, 2011, the Equal Employment Opportunity Commission (EEOC) issued its final regulations implementing the Americans with Disabilities Act Amendments Act of 2008 (ADAAA), which was enacted on September 25, 2008 and became effective January 1, 2009. The Act made a number of significant changes to the Americans with Disabilities Act's (ADA) "disability" definition, "reinstating a broad scope of protection under the ADA." In keeping with this purpose, the EEOC states that "the definition of 'disability' shall be construed broadly in favor of expansive coverage to the maximum extent permitted by the terms of the ADA."
