Lawyers frequently team with other professionals to meet clients' needs effectively and economically. At times, however, a lawyer's relationship with a nonlawyer can create serious ethical problems. What are the ethical limits of partnering with a nonlawyer, and how can a practitioner ensure that she or he doesn't cross them in the course of helping clients?
This video download program will:- bring you up to date as to the ethical considerations applicable to teaming with nonlawyers;
- provide you with information critical to effective and ethical partnering; and
- explore the mistakes that can cause discipline problems.
Among the Model Rules implicated in this discussion will be:- Rule 1.2(c) limiting scope of representation without informed client consent;
- Rule 1.4 communication with client;
- Rule 5.3(b) duty to supervise nonlawyer assistants;
- Rule 5.4(a) sharing legal fees with nonlawyers;
- Rule 5.4(b) forming a law partnership with a nonlawyer;
- Rule 5.5(a)
- assisting the unauthorized practice of law;
- Rule 7.2(b) giving something of value for recommending the lawyer's services; and
