In these difficult economic times, many owners Project Owners are tempted attempt to exercise additional control over the contractors and design professionals they contract with. These Owners are trying to control risk. They sometimes do so by including onerous contract provisions that are intended to help insure that if there is a dispute that the Owner will prevail.
There are limitless ways that an Owner can try to gain an advantage. A contract that contains over-reaching provisions can poison the relationship between an Owner and the project contractors and design professionals. Time and energy that should be devoted to getting the job done is shifted to determining and developing bases for claims. This presentation is intended to examine some of these "ownerous" provisions, and to analyze whether the actual effect of these provisions is what the Owner intends.
