The Internet Corporation for Assigned Names and Numbers (ICANN) recently approved the New Generic Top Level Domain program, allowing the registration of virtually any top level domain.
In addition to owning brand-specific second level domains under ".com" or ".org," entities may now purchase customized ".brand" or industry ".keyword" top level domains. The decision to purchase a TLD should not be taken lightly because it has significant initial costs as well as ongoing costs and responsibilities.
However, even those who are not considering applying need to be aware of the risks and costs they are likely to face in monitoring and enforcing their trademark rights in an exponentially growing sea of cybersquatters and counterfeiters. They need to understand the legal mechanisms for taking action against domain name registrants as well as against domain name registrars in some cases. Strategies to pursue will require knowledge of what the new gTLD program entails, its various trademark policies, and an analysis of the benefits and problems of the program. As the new gTLD program will fundamentally change the internet, this discussion will prepare mark owners for that change.
