*Capacity

Assessment of Older Adults with Diminished Capacity: A Handbook for Psychologists

American Bar Association Commission on Law and Aging and American Psychological Association Assessment of Capacity in Older Adults Project Working Group. This handbook is designed for psychologists evaluating civil capacities of older adults. Contemporary probate law encourages functional assessments that describe task-specific deficits rather than global findings. With training in standardized cognitive and functional assessment, psychologists are in an ideal position to provide such evaluations. The specific goal of this handbook is to review psychological assessment of six civil capacities of particular importance to older adults, namely, medical consent capacity, sexual consent capacity, financial capacity, testamentary capacity, capacity to drive, and capacity to live independently. The handbook also addresses the important topic of undue influence and introduces emerging areas of interest, such as the capacity to mediate, the capacity to participate in research, and the capacity to vote. Relevant literature, suggestions for assessment tools, and case examples are provided throughout. 146 pp. 2008. 10-digit ISBN: 1-60442-234-3, 13-digit ISBN: 978-1-60442-234-4, ABA Product Code: 4280029. $25.

Assessment of Older Adults with Diminished Capacity: A Handbook for Lawyers

American Bar Association Commission on Law and Aging and American Psychological Association. With the coming demographic avalanche as the Boomers reach their 60s and the over-80 population swells, lawyers face a growing challenge: older clients with problems in decision-making capacity. While most older adults will not have impaired capacity, some will. Obvious dementias impair decision-making capacity-but what about older adults with an early stage of dementia or with mild central nervous system damage? Such clients may have subtle decisional problems and questionable judgments troubling to a lawyer. Assessment of Older Adults with Diminished Capacity: A Handbook for Lawyers offers ideas for effective practices and makes suggestions for attorneys who wish to balance the competing goals of autonomy and protection as they confront the difficult challenges of working with older adults with diminished capacity. 80 pp. 2005. ISBN 1-59031-497-2/ Product Code: 4280025. $25. L

State-Level Guardianship Data: An Exploratory Survey
By Erica Wood. Guardianship is a critical protection for at-risk, frequently elderly individuals. However, it is also a drastic intervention in which the guardian is given substantial and often complete authority over the lives of vulnerable wards, and press accounts have detailed significant instances of malfeasance and exploitation. Yet, basic data on guardianship is scant, offering courts, policymakers, and practitioners little guidance for improving the system. Learn more about the extent and kinds of guardianship information reported and maintained at the state level in this ABA Commission on Law and Aging report, commissioned by NCEA. August 2006. *Health Care: Decisionmaking

Incapacitated and Alone: Health Care Decision-Making for the Unbefriended Elderly
Incapacitated and Alone: Health Care Decision-Making for the Unbefriended Elderly presents the findings of a ground-breaking study aimed at improving medical decision-making on behalf of older patients incapable of making their own decisions and lacking surrogate decision-makers. Conducted by the ABA Commission on Law and Aging, in collaboration with the Samuel Sadin Institute on Law, Brookdale Center on Aging of Hunter College, this innovative study and report informs health care professionals, administrators, attorneys, regulators, advocates, legislators, and other policy-makers about existing law and practice, barriers to optimal decision-making, and cutting-edge solutions and options for the future. Specifically, the report assesses the current state of the law and practice and lays out policy recommendations on the best mechanisms for health care decision-making for this population. Through these efforts, the report seeks to enhance medical decision-making on behalf of isolated adults, reduce over-treatment and under-treatment, and improve the quality of care delivered in acute care, long-term care, and the community. 62 pp. (2004) $25. Consumer’s Tool Kit for Health Care Advance Planning
If you are looking at this tool kit, you are either thinking of making a health care advance directive (such as a living will or durable power of attorney for health care), or you may have already signed one. In either case, you should be aware that just having a written advance directive by itself does not ensure that your wishes will be understood and respected. Studies have shown that standard advance directive forms do little to influence end-of-life decisions without: 1) informed, thoughtful reflection about your wishes and values, and 2) personal communication between you and your likely decision-makers before a crisis occurs. Good advance planning for health care decisions is, in reality, a continuing conversation—about values, priorities, the meaning of one's life, and quality of life. To help you in this process, this tool kit contains a variety of self-help worksheets, suggestions, and resources. The tool kit does not create a formal advance directive for you. Instead, it helps you do the much harder job of discovering, clarifying, and communicating what is important to you in the face of serious illness. 28 pp. (2005). ABA Commission Product Code: H4436. $5 (bulk purchases: $5 each for 1 – 24 copies; $4 each for 25-99 copies; $3 each for 100-499 copies; $2 each for 500+ copies). *Order from the Commission. C

80 pp. 2005.
