Advances in exploration and production technology have enabled the development of mineral reserves that are not located in traditional oil and gas areas. In assisting clients in real estate matters that involve an oil and gas component, the practitioner must educate the landowner and/or developer in a number of areas. This program attempts to provide the non-oil and gas attorney with an overview of the relationship of mineral law to property law and the resulting title issues that must be considered.
The program will examine the content of a typical oil and gas lease and considerations for drafting purchase and sales agreements as the primary documents that govern the contractual and real property rights, privileges and obligations of the landowner (lessor) and an energy company (lessee). Our experts will address the issues that must be addressed before a landowner grants a mineral lease to a lessee and the job of the lessee’s counsel in crafting key provisions to protect the lessee, the environment, and the resource itself. Care must be taken to address the terms of any acquisition or sale, the representations and warranties to be given by the parties, the term of the mineral lease to be acquired, and whether all rights or a limited set of rights are addressed in the acquisition or sale documents and/or mineral leases.

The ABA will seek credit for this program in the states indicated on this page. The ABA will seek 1.5 hours of general CLE credit in 60-minute-hour states and 1.8 hours of credit in 50-minute-hour states. Credit hours granted are subject to approval from each state. New York: This non-transitional CLE program is approved for experienced NY attorneys in accordance with the requirements of the New York State CLE Board for 1.5 New York CLE credits. Newly admitted attorneys may not earn New York credit for this non-transitional CLE program.
