Business Torts and Civil RICO


About the Committee



Welcome! The Business Torts & Civil RICO Committee focuses on competition law -- both federal and state law -- other than the "traditional" antitrust statutes. In disputes involving business competition and anti-competitive practices, business torts (such as claims for unfair trade practices, interference with contractual relations, and fraud) and civil RICO claims are often used as adjuncts to, or in lieu of, antitrust claims. Likewise, as states strengthen their consumer protection statutes, actions under those statutes are another common means outside of the "traditional" antitrust area for litigants to press claims and police competition practices.

Publications

The Committee publishes a quarterly newsletter, The Business Torts & Civil RICO News, which discusses in depth issues of interest to practicing antitrust lawyers relating to the Committee's broad jurisdiction. Past editions have featured articles relating to indirect purchaser litigation, class action litigation, and developments in civil RICO law. Every issue of the newsletter includes a very useful chart of the most recent civil RICO decisions.

We are always on the lookout for articles and writers for our next edition. RICO State By State: A Guide to Litigation Under the State Racketeering Statutes

Thirty-three states, as well as Puerto Rico and the United States Virgin Islands, have enacted statutes based upon principles first set forth in the federal RICO statute. This comprehensive Guide is the only work that collects and analyzes all of these statutes. The opening chapter provides a detailed overview of the federal RICO statute, emphasizing issues that also impact the interpretation of state statutes. Each subsequent chapter then analyzes the law of a specific state and includes the text of that state's statute. The chapters are organized around familiar principles applicable to RICO litigation and address the scope of civil, criminal and forfeiture liability in each jurisdiction as well as issues such as constitutionality and provisions unique to specific jurisdictions.

This book is an invaluable resource for the civil litigators, prosecutors, defense counsel and judges who handle state and federal RICO cases.
