
This committee deals with intellectual property problems arising out of differences in the laws of various countries; issues concerning the negotiation and implementation of international agreements affecting intellectual property rights; the rights of United States citizens to obtain intellectual property protection in other countries and the rights of foreign authors, inventors and producers to obtain intellectual property protection in the United States; securing intellectual property protection on a multinational basis; and the laws of the United States and foreign countries regarding the importation and exportation of intellectual property products.

December 2012 International Patent News: Europe: The European Parliament approved the European Council's compromise draft of a Unitary Patent Regulation on December 11, 2012. The Unitary Patent Regulation will, once it applies (this could be on January 1, 2014 or later), be effective in 25 of the existing EU Member States -- all except Italy and Spain. Applicants for Unitary Patents will benefit from (i) the unitary effectiveness of their patent in the 25 Member States participating, and (ii) from large cost reductions due to lessened translation obligations. October 2012 International Copyright News: Europe: On October 4, 2012, the Council of the EU finally adopted the Orphan Works Directive (Directive 2012/28/EU of the European Parliament and of the Council of 25 October 2012 on Certain Permitted Uses of Orphan Works), which sets out requirements for enabling a work to be treated as an orphan work throughout the EU, thus allowing it to be made available online by certain public institutions. Announcements IP Forever: Inexhaustible Copyrights and Patents: On March 1, 2013, the IIPR committee sponsored, along with several other committees, a non-CLE teleconference titled "IP Forever: Inexhaustible Copyrights and Patents". Speakers included Yee Wah Chin, Of Counsel at Ingram Yuzek Gainen Carroll & Bertolotti, LLP (New York, NY), Alex Feerst, Associate at Durie Tangri (Menlo Park, CA), Benjamin Liu, Assistant Professor at John Marshall Law School (Chicago, IL), Matthew Siegal, Partner at Stroock & Stroock & Lavan LLP (New York, NY), and Johanna K.P. Dennis, Associate Professor at Southern University Law Center (Baton Rouge, LA) and IIPR Committee Co-chair. The speakers discussed issues in intellectual property exhaustion and foreign IP exhaustion generally, and as they relate to two pending US Supreme Court cases: Kirtsaeng v. John Wiley & Sons, a case involving the copyright first sale doctrine and Bowman v. Monsanto, a case involving patent exhaustion for self-replication technologies (soybean seeds).
