Professionals' Officers' and Directors' Liability

PODL focuses on insurance coverage and risk management issues relating to professionals', officers', and directors' liability insurance and professional liability. Its membership includes representatives from the insurance industry, corporate risk managers, as well as attorneys practicing in this area.

Join Us at the ABA Annual Meeting In Chicago! PODL will be co-sponsoring a post-CLE/CE reception with the PLUS Mid West Chapter on July 31, 2015 at the Chicago Park Hyatt Hotel. The program, “Trials and Tribulations: Cyber & Privacy Risks for Lawyers” will be presented by Kari Timm of Bates Carey and Michael Flanagan of Big Data Insure. The CLE will commence at 5:30 with a reception at the Park Hyatt to follow from 6:30-8:30. The program has been approved for 1 CE credit in Illinois and California and 1 CLE credit in Texas and California. CLE credit has been applied for in Illinois and CE Credit has been applied for in Texas. All CLE and CE Credit is being provided by PLUS. We’re expecting a great turnout for this fantastic program and hope you can join us! PODL Dinner We are planning a Dutch treat PODL dinner directly after the networking reception at Ditkas at 100 E. Chestnut Street at 8:45. Please email Barbara Costello (bcostello@kbrlaw.com), if you are interested in attending so we may include you in the headcount. Many thanks to our membership chair, Greg Monaco, for organizing the dinner.

The PODL Business meeting will be held on July 31, 2015 at 4pm at the Swisshotel Chicago. If you are interested in attending other TIPS sponsored CLE at the annual meeting and will not be attending any non-TIPS sponsored CLE at the annual meeting; you need only register for the meeting as a general attendee for $50 (at the bottom of the form). You can register at: www.americanbar.org/calendar/annual.html All of the TIPS programs presented at the Swissotel Hotel will be offered free of charge to all TIPS members who pay the $50 general meeting registration fee.

The Global Directors & Officers Deskbook is now available!

We are pleased to announce the publication of The Global Directors and Officers Deskbook, at reatise on International D&O edited and co-authored by Perry Granof and Henry Nichols. The book, which includes chapters from several PODL members, is the first of its kind in that it covers both international D&O liability and coverage issues attendant to those liabilities. It’s a fantastic treatise and is certain to be come a valuable tool for our members. You can order your copy now at the TIPS Member discounted rate.

PODL Seeks Authors for TIPS Law Journal Annual Survey

PODL is currently seeking authors for the Accountants Liability and Agents and Brokers Liability sections of the Annual Survey. The Annual Survey provides an overview of the most important d in the law (case law and or new regulations) during the period of 10/1/13 - 11/1/14 and discusses their impact from both a liability and coverage perspective. Submissions, which should be between 5-10 double spaced pages, including foot notes, will be due in late October. Sample extracts from our prior journal submissions can be found on the PODL committee website: http://apps.americanbar.org/dch/committee.cfm?com=IL220000. It's a great opportunity to contribute to a widely-read journal!

A Day At Lloyd’s ”Seminar An Unmitigated Success!

Knowledgeable speakers. Compelling, informative presentations. Apanel discussion providing wide-ranging and essential perspectives on Lloyd’s-related disputes. All in front of a packed house, filled with practitioners asking terrific questions. This is why you want to be a member of PODL. No wonder PODL Chair Perry Granof called the seminar “an unmitigated success.”

The program provided an introduction to the Lloyd's market structure, an analysis of the process of placing a risk with Lloyd's syndicates and an overview of Lloyd's claims management process,including a discussion of the Lloyd's Claims Transformation Programme. The second half of the seminar explored the complex issues that arise when disputes occur between Lloyd's syndicates and their insureds. The program also addressed the legal issues pertaining to conflicts among syndicates with respect to both primary and excess layers as well as with reinsurers. The panelists reviewed the anatomy of a coverage dispute from first tender through resolution with there insurer, as well as the advantages of using alternative dispute resolution to manage these conflicts effectively and efficiently.

A Few Words From Chair Barbara Costello


As the committee chair I would like to welcome you to the Professionals', Officers' and Directors' Liability Committee. PODL members specialize in liability claims against professionals, officers and directors, and the issues relating to insurance coverage for those claims. Our diverse membership includes in-house insurer counsel, coverage counsel representing both insurers and policyholders, plaintiff and defense counsel, as well as members of the judiciary.

We are in a unique position to offer educational and marketing opportunities in many different practice areas. These include the liability of lawyers, accountants, architects, engineers, medical professionals, agents and brokers and directors and officers of public and private (profit and non-profit) corporations, as well as insurance coverage for these liabilities under directors and officers (D &O), errors & omissions (E&O), and other types of professional liability policies. We hold several CLE webinars and teleconferences each year on hot topics focused specifically on these PODL fields.

We have an active committee and we welcome anyone who wants to participate and take advantage of the tremendous leadership, lecturing and publishing opportunities PODL offers. Our members contribute regularly to The Brief, TortSource, the TIPS Law Journal, and PODL's newsletter. These publications reach thousands of lawyers and potential clients around the country.

We offer networking and marketing opportunities throughout the year and hold events in many major cities. With PODL, you will be involved with a diverse group of lawyers from around the country who are involved in both domestic and international issues in your practice area. Our members expand their professional horizon significantly by being involved in the activities of this committee.

This year we are planning a number of unique educational programs for which we are looking for speakers. We are also always soliciting ideas and participation from our members for CLE programs, newsletter articles and other publishing opportunities and hold monthly conference calls to keep our members apprised of these opportunities.
