Who We Are and What We're Talking About

The Committee focuses on the special problems and challenges that the Internet has posed and continues to pose to practitioners of U.S. and international trademark law. We keep tabs on developing caselaw, pending legislation and the activities of ICANN, while serving as a resource for ABA members in this field. We have monitored and reported on:

• The introduction and administration of the new generic top-level domains (gTLDs) and ICANN's nascent procedures for resolving disputes involving these new gTLDs.

• Online trademark infringement, dilution and unfair competition.

• Use of trademarks in social media.

• Developments in uniform domain-name dispute resolution procedures (UDRPs).

• Fair use of trademarks online, in parodies, criticism and the like.

• The use of trademarks in search-engine optimization ("SEO"), such as metatags and RSS feeds.

• The development of formal and informal "take-down" regimes for online uses of trademarks.

• Keyword advertising.

• The protection of domain names, both as trademarks and sui generis,

• The regulation and practices of domain-name registrars and registries.

Place: The Brandeis Room, Third Floor, Boston Marriott Copley Place Hotel (the same hotel where IPL is going to be headquartered)

The 2014-2015 Committee leaders are Rick Sanders, chair, and Phillip Barengolts, vice-chair. At the Committee's meeting we will discuss what you’d like to the committee to do this year and, building on Chrissie’s work over the last two years, our ideas for organizing the committee so it can do these things more efficiently. The meeting is expected to 45 minutes or so.
