Mission

We recognize that there are other issues that surround and influence estates and trusts outside of taxes. The committee reviews, analyzes and suggests solutions related to the non-tax issues of planning and administration. Activities of the committee include sponsoring CLE programs and writing articles with practical information for trust and estate attorneys and commenting on proposed legislation affecting estate and trust administration.

Trustee’s Beware: Power to Adjust Is Not How to Get Money to Beneficiaries

When asked what he would do if he found a million dollars, Yogi Berra replied, "I'd find the fellow who lost it, and, if he was poor, I'd return it." Recent economic times have financially pinched many who depend on interest and dividends. Trust beneficiaries are no exception, and they are more and more frequently asking trustees to use the power to adjust to replace lost yield. This session will explore the issue, as well as the law and financial theory behind the power to adjust, and it is for those who represent trustees, beneficiaries and draft trust documents. Our own Mark R. Parthemer, Managing Director of Fiduciary Counsel-Southeast Region of
Bessemer Trust, will be presenting this session’s topic.
