to arbitrate (submission agreements); Institutional v. non-administered arbitration;
General function and limitations of arbitral providers; Common applicable rules – AAA,
JAMS , CPR (non-administered), FINRA.

Topics covered: How to best effectuate the various roles arbitrators assume; The importance of informed, deliberate decision-making; Nature of the disclosure statement; the Commonwealth Coatings Standard; Duty to investigate disclosure issues; Continuing obligation of the duty to
disclose; Arbitrator selection; Party arbitrator practice.

Luncheon: Reducing Cost and Delay in Arbitration: Mutual Challenges, Mutual Opportunities
Abiding concerns regarding the expense and length of commercial arbitration recently
motivated the College of Commercial Arbitrators to host a National Summit co-sponsored by
the AAA, CPR, JAMS, the Chartered Institute, the ABA Dispute Resolution Section and the
Straus Institute. The Summit was the first time in-house and outside counsel, arbitrators and
representatives of provider organizations came together to discuss these difficult issues and
collaboratively discuss potential solutions.

Topics covered: Jurisdiction and arbitrability; Reviewing arbitration agreements/pleadings;
Early issues (identifying claims/consolidation/ mediation); Initial pre-arbitration information
exchange (discovery, exhibits, witnesses, briefs); Hearing (date, location, special needs);
Award (forum, written opinion, retention of jurisdiction); Demonstration of an effective prehearing conference; Pitfalls to avoid.
