This session will address the duties of the client and counsel regarding electronic evidence, what to look for during discovery, and related ethical considerations including preventing the spoliation of electronic evidence. The program will discuss trial admissibility issues that arise concerning electronic evidence as well as issues regarding the Federal Electronic Signatures Act.

Two lawyers with several decades of experience in litigating juvenile court child abuse and neglect cases, writing educational materials on case handling reforms, and training attorneys and judges throughout the country, will provide an overview of the dependency case process, including how changes in federal law and policy are affecting local judicial responses to child maltreatment. They will describe innovations in good practice, both in representing children (as attorneys or guardians ad litem) and in representing accused and non-custodial parents in these proceedings. Important areas of statutory reform and court practice changes that are spreading throughout the country will also be discussed. Attendees will have the opportunity to questions two of the child protection law field's most distinguished experts on case-related issues.
