The year’s most important event for international lawyers is the Spring Meeting of ABA International in Washington, DC, April 14-18.

This is an exciting time when changes and challenges to international law and practice have never been greater.  If you practice international law full-time or part-time, you cannot afford to miss this very important meeting – for the substance, for the contacts and for your own professional development.

Why is the 2009 Spring Meeting so special?

Over 1,200 participants from over 50 countries will attend the more than 80 world-class, substantive, programs being presented: three full days of programming in 8 program tracks covering all practice areas of international law: Corporate Counsel/Transactional; Dispute Resolution/Litigation; International Trade/Customs; Regulatory/Regional; Public International Law/Rule of Law; Young Lawyers; Taxation; and Environmental Law/Climate Change.  If held as stand-alone conferences, each of our program tracks would be among the most substantive meetings of the year for these practice areas.  Registrants may earn up to 24 Continuing Legal Education (CLE) credits (also including Ethics) by attending the three full days of programming.

And that’s not all! The Council of the Section, with many of the world’s greatest international lawyers, meets on Saturday morning to debate the hottest policy issues in the field - all meeting registrants are invited to attend at no extra charge!  If you were to go only to the Council meeting, you’d get your money’s worth!

Speaking of money’s worth, NOW is the time to register and get the early bird rates.  The Spring Meeting is still the best deal for practitioners anywhere: the best quality and the lowest prices per CLE credit.

The Spring Meeting will celebrate ABA International’s 130 years of setting the standard for the world’s international lawyers. This meeting is being co-chaired by three superb lawyers: Meaghan McGrath-Beaumont, Senior Counsel, International Finance Corporation, Lori Sostowski, partner at Hogan & Hartson, and Marcy Stras, partner at Baker & Hostetler – the first major law meeting where all the co-chairs are women!  They have been greatly assisted in their planning efforts by three other women: our Membership Officer, Lisa Savitt, our Rule of Law Officer, Lelia Mooney, and our Programs Officer, Yee Wah Chin, and by our COO, Mike Burke, and by our Meetings Guru and former Section Chair, Mike Byowitz. In addition, the Section’s committees and their officers have been heavily involved in the planning. The resulting line-up of programs and speakers is absolutely stunning. You must attend!

Special Events include:

  • a special opportunity to meet with senior staff of the House and Senate committees with jurisdiction over issues important to Section members.  Representatives of the chairs and ranking members of these key committees will discuss their international priorities for the coming year.  Attendees will also have the opportunity to ask questions about upcoming legislation.
  • an opening WIN/SIN/GIN/YIN Outreach Reception at The Fairmont, Washington, DC;
  • Reception and Committee Dinners at The John F. Kennedy Center for the Performing Arts;
  • a closing Ambassadorial Reception in the Diplomatic Rooms of the U.S. Department of State,
  • two award luncheons with prominent speakers including Former Congressman Michael Oxley (Sarbanes-Oxley), Vice Chairman, The Nasdaq Group Inc. and Counsel, Baker & Hostetler LLP and Abbe David Lowell, Former Counsel to the U.S. House of Representatives;
  • Swearing-in Ceremony: U.S. Court of International Trade and U.S. Court of Appeals for the Federal Circuit
  • a special luncheon for committee members, new and old, at a reduced price, and
  • a meeting of the prestigious Council of the Section preceded by remarks by Ambassador Hans Corell, Under-Secretary-General for Legal Affairs and the Legal Counsel of the United Nations, upon whom will be conferred the World Order Under Law Award

Policy Developments from the Council’s 2009 ABA Midyear Meeting

The Section Council met on Friday, February 13th to consider several important policy initiatives.  The Council approved co-sponsorship of the following policy recommendations:

  • From the Standing Committee on Professional Discipline amending the Model Rule of Professional Conduct 1.10 (“Imputation of Conflicts of Interest: General Rule”) to permit the screening of a lawyer who moves laterally from one private law firm to another, so that conflicts of interest that apply to the moving lawyer under Model Rule 1.9 (“Duties to Former Clients”) are not imputed to all the other lawyers in the new law firm (http://www.abanet.org/leadership/2009/midyear/revision_amendments/Revised_109.doc)
  • From the Sections of Criminal Justice and Individual Rights and Responsibilities supporting legislation and/or administrative standards to ensure due process and access to appropriate legal assistance for persons arrested or detained in connection with immigration enforcement actions and encourages bar associations to raise awareness of the rights available to individuals taken into custody during workplace immigration enforcement actions http://www.abanet.org/leadership/2009/midyear/recommendations/101C.pdf; and
  • From the Section of Individual Rights and Responsibilities and Commission on Immigration supporting the enactment of legislation and the implementation of public policy to enable a United States citizen or lawful permanent resident who shares a mutual, interdependent, committed relationship with a non-citizen of the same sex to sponsor that person for permanent residence in the United States http://www.abanet.org/leadership/2009/midyear/recommendations/108.pdf

The Council also heard the following:

  • An Akzo-Nobel case  update – that the European Court of Justice had rejected the ABA’s application to intervene;
  • A preliminary discussion on a future policy initiative regarding the Arbitration Fairness Act of 2007; amd
  • A report on a project to develop a uniform act that would provide a basis in the United States for “Mareva-style” injunctions, which have been adopted in England and most common law jurisdictions.

  • People’s Republic of China’s Ministry of Commerce Anti-Monopoly Bureau, Economic Analysis Office on the aspects of the Guidelines for Definition of Relevant Market of China’s Ministry of Commerce - Cover Letter | Comments

  • European Commission in response to the questionnaire issued by the European Commission in Connection with its Review of the Current Regime for the Assessment of Horizontal Cooperation Agreements - Cover Letter | Comments

MEMBER NEWS

Our thanks and gratitude to Mark Wojcik who recently completed his tenure as editor-in-chief of the International Law News.  Mark’s last issue was the expanded fall 2008 issue that commemorated the Section’s 75th year as a section and 130 as an entity within the American Bar Association.  Mark continues his important leadership role as Publications Officer for the Section.

Congratulations to our Financial Officer Bart Legum who recently joined as a Partner in the Paris Office of the Salans law firm.

NEW COMMITTEES

India Committee - supports ABA members with interests in India related legal matters. Committee work, including programs, both in the US and India, includes review, analysis, comment and information sharing on matters of law, policy and legal practice. Within India, the committee intends to facilitate links and understanding between the US and legal practitioners and law students in India. Join Now!

International Mediation Committee - monitors and encourages the development of international mediation and other ADR processes (excluding arbitration) internationally to resolve commercial and investment disputes. IMC will  provide a community for section members who are interested in the field (through participation in the committee list serve and at committee meetings); develops CLE programs, session proposals, newsletter articles, committee newsletters, public service projects, and/or publication(s) to assist members; and may, on occasion, make policy recommendations. The Committee will promote the understanding and uses of mediation, and offer members ways to incorporate international mediation into their practice and to promote best practices in the field.  The IMC will work collaboratively with the International Arbitration Committee (IAC) of the ABA SIL as well as other related ABA and non-ABA entities to promote the use of mediation and other ADR processes internationally. The IMC will also enhance the Committee's membership, as well as the diversity of the Committee's leadership. The Committee will provide information and technical assistance to members, legislators, courts, government departments and the general public on the conduct and promotion of mediation and other ADR processes internationally.
