After 9/11, the United States created US-VISIT and other systems to screen global travelers and other countries adopted different systems. These new “security” systems have sometimes impeded the flow of legitimate travelers and they also raise privacy concerns. Our distinguished panelists will discuss (i) the challenges that new screening systems such as US-VISIT pose for global travel and privacy; (ii) the laws governing these systems; and (iii) the varying approaches taken by the United States, Canada, China, and other countries.

The growing scientific consensus that our climate is already undergoing major change challenges law and lawyers. Efforts to minimize climate change are essential, yet insufficient. Without knowing the full measure of change, how can law foster adaptation to climate change, including sea level rise, more extreme weather events (floods and droughts), shifting areas of agricultural productivity, changing ecologies, and so on? This panel begins the discussion on the possibilities of law in fostering adaption to climate change.

This program is designed to explore the myriad of evolving legal issues engendered by the global HIV/AIDS pandemic, and the obligations and opportunities that command the attention of international lawyers. The panel will address implementing effective prevention programs, rights of women, rights to health and to treatment for HIV and AIDS, slowing workforce attrition, protecting intellectual property, reducing the impact of HIV and AIDS on private sector growth, and preserving national security and global stability. The program also will celebrate a new international collaboration between the ABA Section of International Law, the Canadian HIV/AIDS Legal Network, and the HIV/AIDS Policy & Law Review.

This program addresses the challenges of reconciling immigration concerns and those of free trade - in short, the challenges posed by national and local regulatory systems in the world's markets for legal services, in which the needs of increasing numbers of clients are global. We will consider these issues in the context of three cases now the subject of petitions for certiorari to the U.S. Supreme Court--in each of which an individual foreign national, lawfully within the United States, was denied full admission to practice solely because of his or her immigration status. We will also explore the tension between the common practices of many U.S. and foreign lawyers to provide legal services on a "fly in/ fly out" basis using business visitor visas to enter a country, and claims of bar regulators that this activity may constitute the "unauthorized practice of law." In many jurisdictions, the "practice of law" is defined more narrowly than is usual in the United States, making the negotiation of reciprocal access rules more difficult. Moreover, the GATS contemplates trade in all services by four modes, the most crucial of which assures individuals from one signatory rights to offer their services within the territory of all others. Yet that implicates "immigration policy" that the U.S. Congress views as outside the proper scope of trade agreements.

Dr. Hans Blix is, since 2003, Chairman of the International Commission on Weapons of Mass Destruction. Prior to that position, Dr. Blix was Head of UN Monitoring, Verification and Inspection Commission  (UNMOVIC), 2000-2003.

Ambassador Thomas Graham, Jr., a former senior U.S. diplomat, was involved in the negotiation of every major international arms control and nonproliferation agreement of the past 30 years .
