Message from the Chairs

 

The Alternative Dispute Resolution Committee is enjoying a terrific year. We are proud of the programming our committee sponsored at the Section of Litigation’s Annual Conference in New York City, April 21–23, 2010, including “Trying the Arbitration Case: Winnable Strategies,” “Class Dismissed! Stolt-Nielsen and Silent Arbitration Clauses,” and “Trends in International Arbitration Procedure.” These CLE programs were excellent opportunities to tune in on the latest strategies and issues in alternative dispute resolution, and we are planning to post course materials on our website soon. We were also glad to connect with many of you in New York City. Join us in congratulating Rebecca Williams who was named Outstanding Subcommittee Chair at the ABA Section of Litigation Annual Conference in New York City!


On a similar note, please plan to attend the ABA Annual Meeting in San Francisco. The Section of Litigation will meet there from August 5 to 8, 2010. We expect the meeting to be filled with tremendous programs and to offer opportunities for you to network with judges and lawyers from around the country.


Check out the materials from the recent ABA teleconference moderated by Charlie Denton, “In the Eye of the Storm: Effectively Resolving Emerging Climate Change Disputes.” We also encourage you to enjoy the winter/spring 2010 issue of Conflict Management, which is chock-full of educational articles like the first part of Rebecca Callahan’s “What to Do When Insolvency Becomes an Issue in Mediation,” Mitchell Marinello’s article “Should Your Firm’s Engagement Letter Contain an Arbitration Clause?,” a case alert by Manjit Gill about Jackson v. Rent-A-Center West, Inc., to be heard by the U.S. Supreme Court on April 26, entitled “Who Decides Whether an Arbitration Agreement is Unconscionable?,” and an article by Richard Fincher called “Mediating Disputes of the Highly Paid Executive,” which first appeared in the Commercial and Business Litigation Journal last fall.
