Message from the Chairs

Greetings! The Professional Liability Litigation Committee has more than 1,400 members litigating cutting-edge issues in claims against attorneys, accountant, directors, officers, and other professionals. We hope you will consider joining us.


The committee helps members stay informed on developing professional-liability trends. What are the ethical and liability risks posed by professionals’ use of social media? What claims are arising from hedge-fund failures, the continuing home-foreclosure saga, and law-firm breakups? Will courts begin to ignore the corporate structures of international accounting firms to assert jurisdiction over foreign branches? Will e-discovery errors become the new frontier of legal malpractice claims? Through its newsletter, website, and frequent case notes, the committee keeps its members up to date on cutting-edge professional-liability issues.


Committee members Scott Bertschi, Dylan Black, and Merri Baldwin have been working with volunteer authors to compile a 50 State Survey of Legal Malpractice Law, soon to be published in book form by the ABA. The survey represents hundreds of hours of hard work. To our knowledge, the survey is the only comprehensive, state-by-state compendium of legal-malpractice law in existence. The book is in its final proofing stages and hopefully will be available by May 2012.


The committee also offers the chance to network and develop business with fellow professional-liability litigators from across the country. At the Section of Litigation Annual CLE Conference in Washington, D.C. in April 2012, committee members met for dinner, staffed a table at a committee expo, and enjoyed drinks together at a private happy hour before the start of the formal social event at the Smithsonian’s National Museum of American History.


We hope you will join us and become involved in sharing your knowledge and experience with other members. In particular, we are always looking for content—articles, news and developments, case notes, commentaries, program ideas—to post on our website or distribute electronically. If you are interested in submitting content, please contact one of our subcommittee chairs.
