Dear Senator Torricelli:

On behalf of the American Bar Association, I thank you for sponsoring S. 654, legislation that would reinstate and make permanent Section 120 of the Internal Revenue Code concerning the tax treatment of employer-paid legal services plans.

The ABA strongly supports group legal services plans as an effective means for helping ensure access to justice for low- and middle-income workers and believes that reinstating Section 120 of the tax code will encourage more employers to offer such benefits.

Attached is a copy of ABA President Alfred P. Carlton, Jr.'s letter to Chairman Baucus and Senator Grassley urging them to include S. 654 in the chairman's mark of any appropriate tax bill being considered by the Finance Committee. We understand that the Senate Finance Committee may mark up a small business tax package, as early as this week. As the chairman's mark is being drafted, Senators Baucus and Grassley and their tax counsels, Russ Sullivan and Mark Prater, respectively, need to hear from S. 654 supporters. Please contact the Senators and their staff as soon as possible to ensure that S. 654 is included in the mark.
