About The Committee

If you practice in the areas of excess insurance, the non-admitted market, or reinsurance, this is "the" Committee to join. No other organization inside or outside the ABA provides its members with the programs, publications, contacts, and information needed to stay on top of the industry like ESLR.

ESLR's quarterly Newsletter keeps members up-to-date with the latest case law developments, insider information on federal legislation, and practical tips on handling complex disputed or regulatory matters involving excess insurance, surplus lines, or reinsurance.

Our subcommittees on In-House Counsel, Excess Insurance, Excess and Surplus Lines Insurance, and Reinsurance allow smaller groups of practitioners to develop programs and publications geared especially for these niche practice areas. Our overall activities and membership involvement allowed ESLR to win the TIPS Committee Award of Excellence for the 1994-95 year.

Some of the issues covered by ESLR are: the relationship between excess and primary insurers, including questions of inter-company bad faith, drop-down liability, and stacking of coverage; analysis and development of laws and regulations covering the surplus lines market, broker/non-admitted company relationships, fronting arrangements, and captive non-admitted carriers; the relationship between reinsureds and their reinsurers, including disputes resolved by arbitration, mediation or litigation, insolvency issues, reinsurance intermediaries and their roles, the duty of utmost good faith, and the allocation of environmental and continuous injury claims among insurers and reinsurers.

We invite you to join ESLR and become part of our growing membership of in-house and practicing attorneys actively involved in this exciting practice area.

For enrollment in a committee of the Tort Trial & Insurance Practice Section, simply fill out the on-line committee application form.

Please note:  If you are already a Tort Trial & Insurance Practice Section member, you may join up to three (3) committees at no additional cost. However, if you are not a Section member, you must join the Tort Trial & Insurance Practice Section first.
