During this political season, "Change" has become the mantra. In January 2009, the Fidelity & Surety Law Committee is fully embracing "Change", returning to a familiar location for the MidWinter Meeting, while boldly engaging two days of cutting-edge topics on construction, fidelity, and suretyship over two full days in New York City.
To comfort those of us who tend to gravitate toward the familiar, MWM 2009, the 75th Anniversary of the Fidelity & Surety Law Committee, returns to The Waldorf=Astoria, the grand hotel on Park Avenue in Midtown Manhattan. The Waldorf=Astoria, an Art Deco masterpiece that was once the world’s largest hotel, opened in 1931, only a few years before the inception of the Fidelity & Surety Law Committee. The Waldorf=Astoria retains its status as an official New York City Landmark and will serve, once again, as the location to see old friends and renew acquaintances.
While returning to a familiar haunt, MWM 2009 will be challenging the status quo on other fronts. Rather than the usual Friday program of surety and fidelity topics, MWM 2009 will instead be two days of education and presentations from construction, fidelity, and surety leaders. Thursday and Friday were almost not enough time to present the fascinating topics chosen this year. Although the schedule is new, you can still expect to receive the very best continuing legal education available anywhere. Buckle your seatbelts; we are in for a thought provoking, sensationally educational ride!

The FSLC has once again partnered with The Forum on the Construction Industry to present Thursday’s(January 31, 2008)
program, "The 2007 AIA Documents: New Forms, New Issues, New Strategies." Our program is literally a once-in-a-decade
event. This fall, the American Institute of Architects (AIA) will publish its new suite of design and construction
documents and this program will be the first of its kind to focus on the two major agreements, the A201 General
Conditions Document and the B101 Owner/Architect Agreement. There have been a number of significant changes to
these documents. The A201 has a new claims and dispute process, including the introduction of a new concept
called the "Initial Decision Maker." The Owner/Architect Agreement is a new agreement which reflects a
reworking of the prior B141 and B151 Documents. You will learn not only what is new, but also its importance
given what has not changed. Not only have we gathered practitioners who have extensive working knowledge
of these agreements, but also anumber of individuals directly involved in the drafting process. The
program will also highlight the new digital rights documents and how the recent changes deal with the
increasingly digital nature of construction. You will get an inside view on how these documents were
crafted and how they impact your area of practice.

This year, the Fidelity and Surety Law Committee is proud to present a comprehensiveone and one-half day
program based upon a NEW PUBLICATION entitled Loan Loss Coverage Under Financial Institution Bonds.
Following the format of some of our past programs, this year’s program will be comprised of distinguished
speakers addressing the most important issues relating to loan loss claims, from investigation to coverage
to loss calculation and more.
The program is intended for all professionals involved in the handling of loan loss claims, including insurance
company claims representatives and underwriters, banking professionals, attorneys for both claimants and insurers,
and consultants. The faculty, which includes some of the industry’s most experienced professionals, will provide
insights and analysis regarding the handling of loan loss claims, including: the key insuring agreements, riders,
and policy definitions relevant to loan loss claims; practical tips for investigating loan loss claims; coverage
for specific types of loan losses; underwriting issues; loss calculation and accounting adjustments; the use of
experts; how to obtain and use regulatory and Suspicious Activity Reports; and perspectives from the banking
industry on coverage and claims handling. There is something for everyone—from those just getting started to
seasoned professionals who are looking to sharpen their skills or broaden their knowledge. Attendees will
receive a copy of Loan Loss Coverage Under Financial Institution Bonds, our newest publication and the most
comprehensive resource on this topic ever published.

I could not be more excited as I look forward to a terrific surety program in one of the
most beautiful places on earth, Santa Fe, New Mexico: The "Different City" in the "Land of
Enchantment." While it might not be heaven (and who really knows), once you experience
this southwestern gem nestled amongst the evergreens at 7,000 feet in Northern New Mexico,
you at least will understand the meaning of nirvana. If you haven’t already done so, make
plans now to attend what will be one of the best programs our Committee has held in what
will become one of your favorite cities in the world.
THE PROGRAM: All surety claims are not created equal. Some are relatively
straightforward and follow a predictable pattern. Complex construction suretyship can
challenge you at every turn and take on a life of their own. It is this later category
of "complex" claims on which our program will focus.

Please mark your calendars now for what I know will be a great 2007 FSLC Mid-Winter program in one of my
favorite cities, San Francisco, California. We’ll be staying in the middle of everything the City has to
offer at the gorgeous St. Francis Hotel. We have great program Chairs who have assembled a terrific slate
of program participants who I know will keep your attention all day in a program specializing in trial
preparation. The former San Francisco Mayor, long time speaker of the California Assembly and political
power broker Willie Brown will address us during our luncheon. Our first Program Speaker is the legendary
Robert Shapiro, attorney to the likes of Johnny Carson, Linda Lovelace, Darryl Strawberry and, of course,
O.J. Simpson. The wildly funny and informative long time San Francisco columnist, book author and local
historian Paul "PJ" Corkery will address our spouses Friday morning high atop the St. Francis. And,
wonderful sunshine, great food and everything else San Francisco has to offer, awaits you.

Long overdue, the Committee is proud to present a comprehensive one and one-half day program based
upon the Second Edition of the Annotated Commercial Crime Policy. Following the format of the highly
successful combination speaker/workshop programs recently presented by the Committee, the first day of
this program will present a combination of distinguished speakers addressing the most important
substantive areas of the Commercial Crime Policy, followed by a series of interactive workshops
designed for both beginning and experienced claims professionals and practitioners. On Friday
morning, the program will conclude with several additional speakers as well as a distinguished panel
discussing many of the issues developed in the workshop andpresentations. This session of the program

Fidelity & Surety Law Committee Annual CLE Midwinter Meeting
A DAY IN THE LIFE
On January 28-30, 2004, the Fidelity and Surety Law Committee changes
venue and travels to the Westin St. Francis in the heart of San Francisco’s
Union Square for its Mid-Winter Meeting. The program planned for this meeting
is unique for a number of reasons:
- It will combine fidelity and surety into a one-day fast-paced program,
- it will demonstrate to the audience what surety and fidelity professionals deal with on a day-to-day basis, and
- it will provide the audience with techniques for handling those issues, specifically
focusing on negotiating techniques.
It will also be an opportunity for the audience to round out their libraries by receiving the most recent editions
of the Surety Bond Default Manual and the Fidelity Annotated Financial
Institution Bonds.
Please join with others in the fidelity and surety industry to
see what a “Day in the Life” of surety and fidelity professionals is like and to
"see how it is done."
