Health And Disability Insurance Law Committee


Concentrates on matters relating to health, disability, long-term care, accident, medical and hospital expense insurance contracts. Examines the laws and the regulation of laws governing the health and disability areas, including state insurance laws; ERISA; ADA and COBRA; and the interplay between state and federal law.

Letter From the Chair

As my term as Chair of the Health and Disability Law Committee winds down, I see a bright future for the Committee. At times, we hear the complaint that the ABA is comprised mostly of defense attorneys. Not our Committee. In the past few years, we have seen more involvement by plaintiff counsel and the continued support of in house counsel. The mix of plaintiff, defense and in house attorneys makes the ABA unique and membership in our Committee beneficial to everyone’s practice.

Looking to the past, in January the Committee participated in the annual Mid Winter Symposium in Florida. Health and Disability Law presented an ethics program on Mediations and ADR and programs on The Obama Administration and its Impact on ERISA as well as Health and Disability Insurance and the Top 10 Changes in ERISA in Life, Health and Disability Insurance. Thanks to Mala Rafik, the program chair, for making it a success. Next year’s program will be held at Eden Roc in Miami and looks to be just as informative. The location is also not bad!

The strength of the Health and Disability Law Committee is due to the involvement of its members. Many people are involved in such activities as writing articles for this newsletters, writing the Committee’s TIPS Law Journal Annual Survey submission, serving as program chair for our CLE events, speaking at CLE programs and much more. If you would like to become more involved in the Committee, I ask you to join us at the Annual Meeting in San Francisco or feel freeto contact me.

Finally, if you have found your involvement in the Health and Disability Law Committee to be as enjoyable and productive as I and many others have, please encourage your friends and colleagues to join. With your continued support and that of new members, the Health and Disability Law Committee will continue to excel.

In addition, the Committee focuses on relationships among insurers; insured, third-party administrators; health care providers; plan sponsors and fiduciaries; and managed care entities.
