Title Insurance Litigation Committee


The Title Insurance Litigation Committee covers all matters relating to the law of title insurance, both legislative and judicial. Examines contractual and extra-contractual disputes between and among insured, insurers, third parties, and governmental or quasi-governmental bodies.

ABA Annual Meeting

The ABA Annual Meeting will be held in San Francisco from August 5 – 10, 2010. There are a number of events planned specifically for members of the committee.

  • On Friday, August 6, 2010, the committee will host a dinner at Scala’s Bistro, located at 432 Powell Street Cocktails will be served at 6:30 p.m., with dinner beginning at 7:30 p.m.The cost is $150 per person, which includes wine and an excellent four course dinner. Vegan and vegetarian options are available at your request. More information about the restaurant and its menu may be found at http://www.scalasbistro.com.

    To register for the dinner, please send payment and a letter identifying yourself, any guest, and any special requests to Lori Bille, Garrett & Tully, P.C., 225 S. Lake Avenue, Suite 1400, Pasadena, CA 91101.

    The deadline to register for the dinner is July 30, 2010, so please have your checks sent to Ms. Bille on/before that date.
  • On Saturday, August 7, 2010, the committee will conduct a business meeting at 7:30 a.m. The committee will discuss a number of the initiatives taken over the past year and a number of the items on the committee’s agenda for 2010-11.
  • Also on Saturday, August 7, 2010, the committee will host a CLE Program, entitled Fighting the Trustee – Litigating Real Property Issues in Bankruptcy Following the Market Collapse.Bankruptcy experts from around the country will address the defense of title in bankruptcy, what issues are and are not covered under the policy, recent trends in avoidance actions resulting from title defects, and issues related to 1031 exchanges and how those issues have impacted the industry. The program will begin at 8:30 a.m. and conclude at 10:00 a.m.

The ABA TIPS Title Insurance Litigation Committee held its Spring 2010 Meeting on March 4-6, 2010 at the Renaissance Mayflower Hotel in Washing D.C. On March 4, the committee held its traditional networking dinner on the eve of the Spring Meeting at Michel Ricard Citronelle. The next morning, the committee hosted a Continuing Legal Education (“CLE”) Program which consisted of a panel of in-house claims counsel who shared their insights on the sate of the title insurance industry.

At the business meeting on March 6, 2010, the committee discussed making updates to the website and the forthcoming issue of the committee newsletter in Fall 2010. The committee also discussed future plans of the committee including next year’s Spring Meeting in Amelia Island, Georgia on May 18-22, 2011 and the ABA’s annual meeting in Toronto, Canada in August 2011. The committee discussed the value of having a panel discussion with client representatives to explain and discuss their preferences and how attorneys can provide the best client service possible. Incoming leadership includes, Jennifer Stephens as chair, Roberto Soto as chair-elect, Ryan Squire as Newsletter vice-chair, Steven Parker as Website vice-chair, Shawn G. Rader as Membership Vice-Chair, and Morgan Ward as Secretary.
